PILU – Pilates & Du OG

I. Scope

These General Terms and Conditions (GTC) apply to all services provided by PILU – Pilates & Du OG, Rechte Wienzeile 29, 1040 Vienna, Austria. Any deviating terms and conditions of the customer shall not be recognized unless PILU – Pilates & Du OG agrees to them in writing.

II. Conclusion of Contract

Orders may be placed in writing, via email, or by telephone with a corresponding order confirmation. The contract between PILU – Pilates & Du OG and the customer is concluded upon booking individual sessions or session blocks via the “Eversports” booking tool or other booking methods offered by PILU – Pilates & Du OG. Furthermore, PILU – Pilates & Du OG offers memberships, which are payable monthly and include a specific number of sessions.

A right to participate in specific courses or to a specific spot in a course exists only after successful booking and corresponding confirmation by PILU – Pilates & Du OG.

III. Services

PILU – Pilates & Du OG offers Reformer Pilates courses. A class session lasts 50 to 55 minutes.

Bookings are made for individual lessons or blocks of lessons, which must be used within the time period specified in the booking tool. After that, any unused lessons expire without replacement. The repurchase or refund of lessons already purchased is not permitted. A membership has a minimum term of three months and is automatically extended for an additional month if the contract is not terminated within the specified notice period.

IV. Prices and Payment Terms

Current prices are available on the PILU – Pilates & Du OG website and in the Eversports booking tool. All prices include applicable sales tax. Payment is due before the start of the class and must be made via the available payment methods. The right to participate is only granted after full payment has been received.

V. Cancellation and Withdrawal

Cancellation is possible up to 24 hours before the start of the class. If the cancellation deadline is met, the booked class will be credited back to the Eversports account and can be redeemed for a new class.

For later cancellations or no-shows, the full course fee is due. No refund or credit will be provided. PILU – Pilates & Du OG reserves the right to cancel courses if there are too few participants. In this case, fees already paid will be refunded.

Cancelled individual sessions or class passes will be refunded exclusively as a full credit to the corresponding Eversports account and can be redeemed for future classes of your choice.

VI. Liability

Participation in classes and events is at your own risk. Claims for damages of any kind are excluded. PILU – Pilates & Du OG assumes no liability for lost items, health issues, or accidents of any kind during or after the event, neither toward participants nor third parties.

During the event, customers bear full responsibility for themselves and their actions. The booked services are completed at one’s own risk and while in good physical and mental health.

Participants agree to inform the instructor of any existing injuries or health limitations (e.g., surgeries, muscle and joint injuries, cardiovascular conditions) so that these can be taken into account during the class.

If there are any doubts regarding medical fitness, a medical consultation is recommended. PILU – Pilates & Du OG reserves the right to refuse participation. 

Any health issues that arise during the event must be reported immediately to the course instructor so that the training can be adjusted. Failure to report such issues releases PILU – Pilates & Du OG and the teaching staff from any liability. Participants waive their right to claim compensation for damages to the extent permitted by law.

VII. Loss of Personal Belongings

PILU – Pilates & Du OG assumes no liability for the loss or theft of personal belongings on the premises. Valuables should not be left unattended.

VIII. Online Presence and Reviews

Customers agree to write reviews, comments, or other public statements about PILU – Pilates & Du OG, its services, instructors, and premises in a factual, truthful manner based on their own experiences. False factual claims, insults, abusive criticism, or defamatory content are prohibited.

PILU – Pilates & Du OG reserves the right to take legal action, both in and out of court, against unlawful, untrue, or reputation-damaging reviews. This includes, in particular, demanding the removal of impermissible content, seeking injunctive relief, and, where applicable, asserting claims for damages.

PILU – Pilates & Du OG notes that the dissemination of false statements of fact and defamatory remarks may result in civil and criminal liability.

IX. Use of Photographic Material

By participating in classes, the customer agrees that photographic material taken during the classes may be used for promotional purposes. If this is not desired, written notice must be provided.

X. Conduct on the premises

Customers must behave considerately on the premises of PILU – Pilates & Du OG. The use of cell phones in the course rooms is not permitted.

XI. Changes to the Terms and Conditions

PILU – Pilates & Du OG reserves the right to amend these Terms and Conditions at any time. The amended terms will be communicated to the customer via email or in writing. If the customer does not object within two weeks, the changes shall be deemed accepted.

XII. Punctuality and Late Arrival

Participants are required to arrive at the studio no later than 5 minutes before the start of the class.

Arriving more than 5 minutes after the class begins is considered a late arrival. In this case, there is no entitlement to participate in the Pilates class, as joining late disrupts the flow of the class and disturbs other participants.

In the event of a delay in the start of a session as described above, there is no entitlement to a refund, credit, or rescheduling of the booked session. The session is considered to have taken place. This provision is intended to ensure a smooth, high-quality, and uninterrupted course experience for all participants.

XIII. Final Provisions

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.

XIV. Governing Law and Jurisdiction

Austrian law applies. The court with subject-matter jurisdiction in Vienna shall have jurisdiction over all disputes arising from this contract.Terms and Conditions (T&C) of PILU – Pilates & Du OG
